New blog about illegal American Agencies debt collection practices

A reader started his own blog about his American Agencies collection experience:

The allegations are really unbelievable, but as long-time readers might remember, American Agencies employees refused to delete the TOTALLY BOGUS Pacific Bell collection from my credit reports and to add insult to injury, they even ran my credit after I disputed.

The FTC claimed to be investigating American Agencies, but just like the corrupt judges, they allowed them to get away with extortion.  Liars and Cheats EXPOSED is not just another gripe site, but we will expose corrupt regulators such as the FTC if they refuse to take action.

Reader mail: American Agencies won’t quit collecting and reporting 9-year-old disputed debt

Hi Christine,

I just read some of your thread on a fraud forum.  I’ve been contacted by American Agencies and told that I owe a phone bill for a number that was never mine, at an address in LA where I never lived, and at a time (2000) when I wasn’t even living in the country!

Despite this, and despite the fact that the statute of limitations runs out after 7 years, they still tell me it’s a valid debt and that I must prove it wasn’t me!  It appears the same thing happened to you.  I’m wondering what you would advise me to do in the face of their false claims? (They say they continue to report it on my credit report...and will do so until they’ve been paid).

It’s unbelievable how collectors IGNORE the law.

Dispute with the credit bureaus who report the account:

“Please IMMEDIATELY delete the American Agencies collection.  It is NOT my account and even if it was, this debt is from 2000 and should have LONG been deleted from my credit reports.”

And if they are calling you, write to American Agencies:

“This is NOT my account.  Please do NOT contact me again and immediately delete this collection from my credit reports.”

Please contact me if they don’t delete.

The FTC claims to have investigated American Agencies back in 2003 or so when I sued them—can everybody tell how effective the FTC is?  I now document the FTC corruption at http://credit-reporting-collection-ftc-complaints.info/

I hope that many MILLIONS of (near) judgment-proof people will get a clue, stop paying their unsecured debts and leave this corrupt system to let it die.

Reader mail:  American Agencies collecting 10-year old debt

I was contacted by an American Agency representative, who was attempting to collect a 10-year-old debt.  He said I owe $300.  He was attempting to offer me a settlement amount.  I asked him exactly what the amount entailed, and he said he cannot provide me with that information since the debt is so old, but did inform me that it includes 10 years of late fees. I provided him with my mailing address and then went to the American Agency website and sent an email about providing the details of the bill. 

Can this be true?!?!  This just seems completely ridiculous to me. 

Please advise.  I don’t have an account number, as this is the first time I’ve heard of this debt. (At least in the last 10 years)

Do NOT pay that debt.  Since it is OVER 7 years old, they can NOT legally report it on the credit.  And they definitiely can’t get a judgment. Even if the statute of limitations had NOT expired, they’d have to DOCUMENT the debt in court, which they obviously can’t.  Nor would they sue for such a small amount.

Send the “cease and desist” letter INSTEAD of payment:

[your name, address]

[Am. Ag. address, it ought to be on their website]

[date]

Re: Cease and desist collection of disputed debt [provide whatever info you have, account #, original creditor]

Please immediately stop all collection activities and do not contact me again.  Should you have any questions regarding this notice, please contact me by fax to [#, or if you don’t have a fax, request contact by mail]

Don’t provide your SSN.  Send with DELIVERY CONFIRMATION or signature.  They are known liars and won’t hesitate to commit perjury.

When you requesting more information you only encourage more collection efforts and you waste more time on it.

Reader mail: phone number and address for American Agencies CEO

When searching the web for American Agencies, I encountered your every interesting website.  I could not find the information I was seeking, and hoped you would have that information or could point me in the right direction.

I am looking for the names, street addresses and telephone numbers for the president/ceo/owner, etc. of American Agencies regarding collection activities in California.

You don’t sue by making phone calls or serving a corporation at the CEO’s address.  There’s some free info on litigation and the registered agents at http://creditlitigation.org/resources/messages/5/5.html

Reader mail: American Agencies collecting OLD debt with expired SOL

Hello,

First off I would like to say thank you for creating a web page that has the info we need to defend ourselves against unlawful collections.

Upon a google search I came across this page: http://american-agencies-complaints.us/

Though I am not totally grasping every aspect of your directions and advice I am extremely interested in it. I just received a phone call from American Agencies in regards to a collection for Pacific Bell. The phone number and address are correct in regards to a previous address that I resided in, but I did not live there during the time they claim the collection is for. I have no recollection of ever having a phone number under my name at any address that I have resided so this is easy for me to think about. I was only 18 at the time and lived in a different city. The phone was under my room mates name at that address. The number in question was under my parents name at the address claimed. My other problem is that I would think that this collection falls under the statue of limitations here in California. They are collecting for Oct 98 – Mar 99, almost 10 years ago.

Please respond as I am looking for some serious advice on this subject.

Good news, it’s a NON problem.

The SOL in California expired years ago and the account became delinquent over 7 years ago, so it can’t legally be reported to the credit bureaus.  You might want to check your reports to see whether they report it anyway and for this purpose, any cheap/free tri-merged report like http://www.privacyguard.com/ will do.  The tri-mergeds are only good to determine whether something’s on the credit as they do not contain the most IMPORTANT data.

Since American Agencies had the nerve to CALL on this account, you should send a cease and desist letter, advising that they are not to contact you again.  If they report, dispute with the CRAs (factually, as re-aged) and request deletion in the cease and desist letter.

I sure wish I had the time/money to update all these old websites, not enough hours in my day.  I should probably just shut them down, a lot happened in the last 5 years and my advice changed accordingly.  So for more tetails, please subscribe to CreditFactors.
