Netzero mediation failed, moved case to civil division for discovery to document their LIES
After the SECRET mediation got no settlement, I immediately filed my motion to move the case from small claims to the civil division so that I can do discovery and take some depositions. Of course I expected them to insult me some more during mediation, that’s why I had the motion with me.
Just like all the corporate crooks, United Online (Netzero) relies on its RECORDS, which seem to contain nothing but false information.
Just as for Experian, I want to start a separate site dedicated to Netzero’s refusal to close accounts as requested and their audacity to then LIE about it.
I’d really like to see a class action. Not one of those with a coupon for free crappy internet service with no support, but a REAL class action, with cash to the class and a change to their procedures in the “save” department. Oh, and some more accurate record keeping would be nice.
I HATE being lied to and the only thing I hate more is these corporate criminals lying to the court.

United Online (Netzero) lied to the court in its answer regarding its refusal to cancel my account
I just posted the answer.
I am so sick of the lying corporate scum. Thank God I recorded the cancellation call.
And I’m so angry, I’ll have the case transferred to the civil division and I’ll be deposing the lying bastards. Got a gazillion things to do with building and moving, not to mention all the client work, but I’ll just have to make time to prepare my discovery requests. And send out a press release to try to get a class action going.

Netzero finally cancelled my account, trouble serving United Online (NetZero)
I just had the registered agent return the summons, stating that United Online is not registered to do business in California.
Everything I find on the web about United Online states that they are headquartered in Woodland Hills, California, so they must be using an intricate subsidiary/dba structure, as most crooks, trying to avoid service. At the same Woodland Hills address is United Online Communications, Inc. and I had sent it to their agent.
From the Yahoo corporate writeup:
“United Online is headquartered in Woodland Hills, California with additional offices in New York, California; Fort Lee, New Jersey; Renton, Washington; San Francisco, California; Schaumburg, Illinois; Orem, Utah; Erlangen, Germany; and Hyderabad, India.”
Tried all the American locations, no luck. We (as consumers) should do that. Charge up the credit cards, default, and then use some OTHER names and locations accross the country so that we can’t be served and won’t get judgments against us.
Finally thought I’d check Delaware, and there they are. So I have to serve them again.
And, they finally DID cancel my account by email, have to update with our correspondence at Fight Back. But of course they just charged me again and they didn’t refund the fraudulent charges.
The summons goes out to Delaware today.

My email to Jenniffer Sterold, NetZero Customer Care re. cancelleation suit
I was so tired last night, forget to send her the URL of yesterday’s posting about the suit.

Filed suit against United Online (NASDAQ (GS): UNTD) over NetZero refusal to cancel my account
I made a special trip to Kingman today to file the complaint. Later this week I have to pick up my nephew in Vegas and will obviously be BUSY. And of course I had to get this done before I got sidetracked by the next corporation stealing my money ... since they are getting away with it, the corporations are thieving and defrauding continually. I SHOULD be filing at least one lawsuit every month.
Here is the email that motivated me to file the suit, received in response to my 7/6/07 written request for cancellation and refund.
Dear Christine,
I’m sorry to hear that you wish to cancel your NetZero HiSpeed service and hope you will reconsider.
Unfortunately there is no record of your cancellation request. In accordance with our service agreement, cancellations can be made only via telephone. Hence, your account is still active and you will be billed as per the billing policies.
For security reasons, cancellations are not processed over email, instead, please call us toll-free at 1-800-851-7908.
Unless and until you specifically request cancellation, your credit card will be charged according to our billing policies.
You may resolve the issues regarding the refund when you contact us at above specified number.
If you are canceling due to a technical problem, we will be glad to assist you resolve the issue. Please visit our support site at http://www.netzero.net/support or create a Personal Assistance Ticket at http://www.netzero.net/support/pat. A live email technical support agent will respond within 4 hours.

Ms. Sterold has to be one of the DUMBEST people on the planet.
Well, that’s my initial reaction. More likely she was trained to act stupid, I don’t think anybody could really be as dumb as she acts.
I got this mail just before midnight on 7/6 when I did a final email check, was going to bed. It made me so angry, I was up another three hours researching Netzero and the class actions against AOL. The more I read, the angrier I got. And I looked up my recording of the 7/4/06 cancellation call.
Listening to the audio left me foaming at the mouth. I’ll have to find some of these articles about the AOL suit again, you have to read how they train people to keep customers from cancelling. I felt like such an IDIOT for having talked to that moron in the “save” department for 5 minutes a year ago.
The first 2 minutes I listened to music, then I got an automated system with the option to cancel the account, which I selected. I have NO idea why I talked to him for 5 minutes. I PLEADED with him to close my account:
“Could you PLEASE just cancel this account?”
How I could stand it, listening to it now and knowing that I totally fell for their manipulations, I’d like to slap that guy till he’s toothless. My final words were:
“I appreciate it if you just close my account because I’m really busy. Thank you very much.” [hung up]
And now Jenniffer Sterold wants me to call them again, so they can once again have “no record” of my cancellation.
Most people WOULD call them again, only to have to argue with them about closing the account again and in the end be grateful to get it closed WITHOUT getting a refund!
Hell no.
I’ll call their save department to cancel this account when hell freezes over.
I will however send this URL to Jenniffer Sterold. If I were her, I’d quit working for these gangster immediately. And yes, she’s just doing her job, but what happened to having a conscience? How does she sleep at night?
According to Hoovers, their NET income for 2006 was $42 million.
I’d like nothing more than to have at least $20 million spent on class actions.
I’m the perfect named plaintiff for a class action:
1) I have the recording of the original call with my demand to close the account.
2) I submitted my written request.
3) They claimed to have “no record” of my call
4) They AGAIN refused to close my account.
5) To my knowledge, the account has NOT been used by anyone since I requested that they close it over a year ago. That seems to have been a problem with the AOL suits, “friends” or “others” used the accounts after they were supposed to be closed.
And once you read how they INTENTIONALLY commit fraud and theft, you’ll see why I’m so angry. AOL got sued for the EXACT same thing. They DENIED everything and settled for a few million.
I hope I get around to sending my complaint to the AZ AG.
There ought to be a CRIMINAL prosecution.
I can’t just go into the AG’s office once a month and take $15 out of their petty cash or whatever. Or can I? Can I go into corporate offices and just take their money?
I should look up the AOL class actions and contact those lawyers. And I should send out a litigation press release. Do a google for netzero refusal cancel and you’ll see why there SHOULD be a class action. And how quickly my Fight Back topic got indexed, nice.
