Member registration deactivated - moving to Liars and Cheats EXPOSED!

I keep getting emails from readers who can’t activate their membership here and I constantly get spam registrations, so I just disabled the registration.  Unfortunately, that means that you can’t submit any comments as membership is required to submit comments here. The spammers win.

You can still SUBSCRIBE to she occasional new post here, but our new site Liars and Cheats EXPOSED will contain MANY individual blogs about credit reporting, FICO scoring, collection, finance, patients’ rights, corrupt regulators, courts, judges and lawyers, free speech, etc.

CreditSuit is “full” and Liars and Cheats EXPOSED will be much more organized and functional.  You can even start your own blog and we plan on installing discussion forums.

You may have heard that WikiLeaks recently shut down due to lack of funds and what we WILL do depends on YOU.

It was astounding to read the comments submitted at an article about WikiLeaks.  Some people are so incredibly ignorant and actually questioned how much it could possibly cost to run that site.  The ignorance ...

Some of my clients have donated and we will make an effort to keep most blogs ad-free.  The Google ads here currently pay about $100/months, but we’d rather not have to advertise scams and frauds just to get paid for clicks on ads to companies that we’d like to put out of business. 

We are going to start a blog on credit reports and scores, what you get and what you do NOT get, freebies, coupons, etc.

I filed a lawsuit against Trans Union and Verifacts last October, but just now had the TIME and MONEY to try to serve them.  One of my claims is the INCOMPLETE credit reports Trans Union sells through TrueCredit.

Of course I will NOT prevail—the credit bureaus are too powerful and the courts are too corrupt.  I have NO legal skills or resources. But just as with the Capital One credit limits, my litigation serves to establish that there is a serious problem and then the class action lawyers will EVENTUALLY get results, along with a giant check for their legal fees.  I get NOTHING. 

The point of the litigation is to document and publicize the issues and I will be sending my open letters to regulators and media.

Unlike here, everything will be much more organized at Liars and Cheats EXPOSED as we can have unlimited INDIVIDUAL blogs.  But setting up and maintaining blogs takes so much time and we are not web designers or programmers.  We are using WPMU and if you’d like to help or donate so that we can pay for software and support, please visit Support – Accountability

The liars at Trans Union - time for my published FTC complaint

Trans Union attorney Tiffany Cox with Strasburger IGNORED my 8/25/09 email about numerous issues including the INCOMPLETE Trans Union credit reports at TrueCredit.  Most important, it appears that you can NOT obtain your COMPLETE Trans Union credit report unless you dispute.  The investigation results contain the scheduled deletion dates and ALL inquiries including soft account review inquiries and promos.

I just logged into TrueCredit and the advertisements and constant questions about personal information that are NONE of their business are so incredibly offensive.  They’re SELLING the info you provide to marketers and of course they’ll inundate you with obnoxious ads for the worst products while at the TrueCredit site.

Since attorney Tiffany Cox and Trans Union ignore me, I decided “chat with a virtual agent.” Here’s the transcript:

How STUPID are Americans?


THAT stupid!

You know that Trans Union wouldn’t pay upsellit if this crap didn’t work.

And that the FTC lets Trans Union get away with these lies and invasion of privacy is just amazing.  In the 90s, the FTC continually sued Trans Union y with tketing.  Now, Trans Union gets away with these blatant lies and the FTC does NOTHING.

STOP acting like a hamster running on a wheel in the cage.  We do NOT have to pay the banks, we do NOT have to pay for credit reports, we do NOT have to pay income tax and we do NOT have to finance this corrupt system.  There ARE alternatives. You have CHOICES.

Credit bureau lawyers want account numbers for accounts to be reported

Attorney Cara Hergenroether for Equifax wrote today:

I will look into this. However, could you please send all of us a list of the accounts you believe should be on your credit file? If you have account numbers, that would be especially helpful.

They all have my credit reports and THEY could have wasted THEIR time to figure out what’s missing. 

But of course those PREVIOUSLY REPORTED accounts were not at issue, although I made an effort to identify accounts. The point of my original request is to find out whether the FTC is full of crap or whether we can have accounts added that are NOT reported by creditors and how to go about it.

So here’s my response:

Why is there no scheduled deletion date?

As discussed at the deposition, my open GEMB JCP account is missing.  I just got a new report and still don’t see it.

I only see two of the FCNB accounts. 

HOWEVER, if you read my email and the FTC publication, you will see that the issue is the reporting of accounts by creditors who do NOT report to CRAs.

For my own as well as my readers’ benefit, I want to know EXACTLY what it takes to get accounts on the credit reports that are NOT reported by the creditors.

It is PATHETIC that I can’t even get the accounts that ARE reported by the creditors on my reports—DESPITE 8 years of litigation.

It is so aggravating to constantly have to waste your time on this crap.  I’m sure you’ve all seen the IRS and other government forms ESTIMATED time complete their forms.  We should have something like this for credit bureaus and while the time wasted depends greatly on the number of accounts, I’m guessing that the average person would have to spend at least several hours a month and about $30/month to purchase and review the credit reports.

The trouble is, there’s no point to it because as you can see, DESPITE my many years of litigation, I still can’t get accurate and complete reports.  I did get MANY corrections through the litigation, but it’s just AMAZING that they continue to delete POSITIVE accounts.

That’s the amazing part, these accounts are NOT deleted due to disputes, but they just “disappear” without notice.

Credit bureaus claim to report positive accounts for 10 years after the accounts are closed.  That is of course totally unfair and can make a 50 FICO score point difference. 

Why should you pay higher interest, fees and insurance premiums just because you switched banks and your MOST VALUABLE OLD ACCOUNTS are deleted?

I can’t take the time to routinely compare all positive accounts on my clients’ credit reports, but when account history is critical and we see a big difference in FICO scores for the various CRAs, I often find that a prematurely deleted account is the cause of much lower FICO scores.

There is no law requiring CRAs to report accounts, so you can’t sue for it and expect to prevail.  So I recommend to my clients to get Authorized User accounts with a long history if scores are critical. 

Don’t believe the Fair Isaac lies about AU accounts being ignored.

Considering the huge amount of time and money required to POSSIBLY and for a SHORT TIME have the CRAs add prematurely deleted accounts, AU accounts are the way to go for people with friends or family willing and able to help.

So all I can do is publicize these issues and motivate (near) judgment-proof people to STOP paying the large banks.

YOU have to CREATE justice. 

As I documented literally hundreds of times, you won’t find justice even when you sue—you can only LOSE as a consumer in American courts and it is YOUR responsibility and MORAL obligation to send a message to the banks and politicians.

Adding accounts to your credit reports by paying a fee to the CRAs

I’m not aware of this option to pay to have accounts added as described by the FTC at http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre21.pdf

So I sent an email to the attorneys in my suit against the CRAs:

To all,

As you know, several of my accounts (such as JC Penney) are NOT reported on my credit reports.

Adding Accounts to Your File

Your credit file may not reflect all your credit accounts. Although most national department store and allpurpose bank credit card accounts will be included in your file, not all creditors supply information to consumer reporting companies: some local retailers, credit unions, and travel, entertainment, and gasoline card companies are among the creditors that don’t.
If you’ve been told that you were denied credit because of an “insufficient credit file” or “no credit file” and you have accounts with creditors that don’t appear in your credit file, ask the consumer reporting companies to add this information to future reports. Although they are not required to do so, many consumer reporting companies will add verifiable accounts for a fee. However, understand that if these creditors do not report to the consumer reporting company on a regular basis, the added items will not be updated in your file.”

Please let me know what your clients charge, how I pay them and whatever I need to do to get my accounts reported.

Can utility accounts and rentals be added too?

I’ve never heard of the option to pay to have accounts reported and that’s going to be really helpful to many people with thin files and short histories.  Of course I shouldn’t have to pay to get my oldest account JC Penney on my credit reports.  Can’t wait to see how much they charge.

The transcript of my deposition by the CRAs and NCO and my comments

I posted at http://credit-bureau-nco-litigation.info/2009/04/my-deposition/the-transcript-of-the-32709-deposition/ after I got the filing with their motion for sanctions today.  Needed some motivation.

I had planned on filing a motion for clarification regarding judge Teilborg’s order denying the motion to dismiss, but, I’ve been busy and I figured I can just the same put it all in my response to their motion for sanctions. 

An exhibit to my response will be my published complaint to the FTC (see my DeVry / Experian FTC complaint), demanding some changes to the law, including minimum statutory damages for attorney lies to unrepresented consumer litigants and violations of court rules and orders.

As this case documents, the courts actually ENCOURAGE the attorney misconduct!

Don’t bother counting on justice in American courts unless you’re very wealthy. 

STOP paying your unsecured bank debts if you’re (near) judgment-proof.

Vote with your money!
