Systemic violations: Experian failure to report the date of first delinquency and date of chargeoff
I posted the screenshot and some questions:
Experian’s failure to report the date of first delinquency and date of charge-off
This was part of my 2003 suit, my first federal suit, and it cost me over $5,000 to travel to Dallas in 2006 to take Experian depositions. It was a giant waste of time and money.
I had to dismiss Experian after they filed my completely unredacted credit reports on PACER and judge Broomfield refused to have my reports removed. The 9th circuit court of appeals agreed with him.
My petition for rehearing / en banc re. Experian filing my unredacted credit reports
Nobody can claim that I haven’t done EVERYTHING possible short of public suicide to expose the problems.

Experian CreditManager link to NewCreditEra credit card application—leads to Superior Payday Loan
Got an alert today and as I checked what it was for (new address), I noticed the Experian ad for credit cards for people with BAD credit. Experian is an affiliate (gets a commission). I followed the link to newcreditera.com and when I tried to close the window, a popup opened:
Janet says: Hey don’t go! If you’re short on cash between checks we can help. Click Here and get up to a $1500 cash advance right away.
Janet says: It’s FREE to sign up and you really don’t have anything to lose.
Janet says: Our lenders will work with you no matter what your current situation but you need to Click Here to get started.
Janet says: You can get approved in seconds and often get the cash the same day.
Janet says: Everybody needs emergency cash at some point, Click Here and we can help you out fast.
Janet says: If you’re still there, type “Hi” and chat with me for a second. I’m here to help.
You: Hi
Janet says: Thanks for chating with me, just Click Here and I’m sure we can get you up to $1500 in cash in the next 24 hours.
You: I don’t understand where this window comes from
Janet says: If you’d like to exit just click the “X” and close the window.
You: what is the APR?
Janet says: Simple. Just Click Here to fill out our free application, and you’re on your way!
You: are you a real person?
Janet says: My name is Janet and of course I’m not real but wish I were
![]()
Janet says: I can answer most of your questions though.
You: do you know what “APR” means?
Janet says: Simple. Just Click Here to fill out our free application, and you’re on your way!
You: on my way to what?
Janet says: Simple. Just Click Here to fill out our free application, and you’re on your way!
And “click here” was a link to http://img.superiorpaydayloans.com/p/100006[redacted]

My appeal brief regarding the Experian perjury and American Agencies
The longer I worked on that brief, the more pissed off I got. I have no idea how I can even deal with all this BS, the lies, lies and more lies, perjury, and judge Broomfield not giving a damn.
Nobody can imagine how fed up I am.
Been working on a new website just about the Experian perjury and I will be sending out a press release, hopefully next week.
It’s amazing how it’s all so totally depressing that I really didn’t deal with it until I had the appeals deadline. I’m thoroughly motivated now.
Enough is enough!

Wanted: Experian Kimberly Hughes affidavits and depositions
Experian’s Kimberly Hughes submitted two affidavits in my cases and she lied in both.
I’d like to document how the CRA employees lie under oath not only in my cases, but as a general practice.
Unfortunately, the consumer lawyers FAIL to put a stop to this practice, they don’t want to jeopardize their working relationships with the CRAs and their fat settlement checks. And I don’t know what *** I *** can legally do about it.
Do I have a legal claim?
If nothing else, I’d like other consumer litigants to bring those lies to the attention of the courts and maybe we can get some law that provides for statutory damages when the CRAs’ employees commit perjury.
I’m going to post the two Hughes affidavits and proof that she lied within the next couple weeks.
The FCRA should be amended to be similar to the FDCPA and PROHIBIT false statements in litigation, see Debt collection litigation NOT exempt from FDCPA—Sayyed v. Wolpoff & Abramson
I don’t understand why you need a special law to prohibit lying to the court, but if that’s what it takes, that’s what needs to be done.

The morons at Experian just can’t get it right
One of my clients just got the Experian dispute results including the dispute of an MBNA (purchased by BofA) account:
“OTHER ITEMS DISPUTED ARE NOT CURRENTLY DISPLAYING ON YOUR PERSONAL CREDIT REPORT”
Then the Experian results feature this account, IDENTICAL to the previous reporting, but now reported by BofA. Here’s the myFICO reporting:
BANK OF AMERICA (Individual)Not on Record
Account Number XXXX
Account Type Revolving
Credit Limit
(High Credit) $15,000
Charge Off Amount 00015821
Minimum Monthly Payment (Terms)
Date Opened August, 2003
Date of Status June, 2005
Last Payment Date October, 2004
Loan Type Revolving Charge Account
Collateral
Description Transferred to/purchased by another lender Not on Record
Last Report on April, 2007
Balance Current status Past Due Amount
$15,821 Unpaid balance reported as a loss by credit grantor $2,370
Seven Year Payment History
30 days late: 0
60 days late: 0
90+ days late: 25 x 4/2007 - 4/2005 [The fictitious lates added by Fair Isaac and NOT rated by FICO scores]
--------------------------------------------------------------------------------------
The account was PREVIOUSLY disputed.
And how can these idiots at Experian be so stupid? Even if they do NOT know that BofA finally changed the name of the reporting from MBNA to BofA, they should have corrected the reporting.
How could they NOT notice the OBVIOUS incorrect reporting?
An account can NEVER have a balance after it was SOLD!
Not to mention that my client filed for bankruptcy in 8/05 and any outstanding balance was obviously discharged.
Experian gets away with this crap because just about nobody sues them for this BS.
