Mr. Smith from the Phoenix marshals didn’t call back
First I called the marshals office to find out whether yesterday’s visit was legit. Got transferred to a VM, left a message stating that I was concerned and would like to know whether he really was a marshal - she didn’t call me back.
This afternoon I called again and asked for Mr. Schmidt. Got transferred to his VM and left a message requesting investigation and prosecution of judge Broomfield, the attorneys including David Szwak and of course Experian and CIC. Didn’t get a call back.
So, they have time to send a marshal on a 500 mile round trip to deliver two pieces of paper, but not the 2 minutes to call me back. Nice!
A neighbor came by telling me that he was reading the Book of Daniel last night and that it reminded him of my situation.
Nebuchadnezzar gathered the sheriffs and judges and governors to worship the golden image and when 3 boys refused to worship it, he had them thrown in the fiery furnace, but they didn’t burn!
Well, that’s encouraging. It’s all about money and power—which they worship and I don’t have. Realistically, I don’t have a snowball’s chance in hell of prevailing. But then again, one never knows.

U.S. Marshal came to my house - concerned about Judge Broomfield’s safety
First thing this morning, I got an email (thank you!) with my current home address, the address I’ve spent thousand of dollars to keep private so that I don’t have to be afraid of some moron beating the crap out of me or worse—as scammers and drug dealers have threatened to do over the last 7 years. The mail read “This guy has posted a lot of your personal data...” and included a link to David Szwak’s site:

So I scanned through Szwak’s postings about my unredacted credit reports on PACER, posted in DECEMBER while my credit reports were available for download by anyone willing to pay 8 cents/page.

WTF? This moron is associated with the LA Bar? That’s going to be my next Bar complaint.
I was hoping to actually start on my objection to the Equifax/Fair Isaac class action settlement, but I had a few hours of client work to do. In the afternoon I decided to take a break from the computer (my arm is killing me again) and paint to get my home ready for sale.
Just as I got the paint brush, I noticed the sheriff driving by and I watched where he was going, saw him stop a couple lots from my place and a car pulling into my driveway. I went outside to see who it was and I made a remark about wondering whether he was trying to outrun the sheriff, when he introduced himself as “federal marshal” and I got so see his badge for a split second.
He said he couldn’t find my place and that he had needed assistance. And he told me that he was here because there were concerns about judge Broomfield’s safety. He mentioned some criminal cases that he had handled.
So I told him that I don’t understand why MY address can be posted on the court’s website and why judge Broomfield wouldn’t seal my unredacted credit reports. He didn’t know anything about it and didn’t understand that either.
On 4/4/07 I posted at Court refused to seal the Experian unredacted credit reports until I dismissed all claims:

I didn’t get any response or comment from anyone. So on 4/12/07 I wrote at Filed my notice of appeal for the 2003 suit - American Agencies, Experian, CIC:
… An EASY way to find out what my claims are would be to post THEIR credit reports—if anyone can get me the credit reports or has suggestions on how I can get the Experian reports for judge Broomfield, Marc Carlson, Kimberly Hughes, Experian and Jones Day executives, etc.— please contact me privately. For starters, I need their home addresses, any help is appreciated. ...
I actually hadn’t intended to post judge Broomfield’s credit reports at this time, but I was hoping for a reaction. Of course I didn’t expect that the idiots in Phoenix would send a marshal on a 500 mile round trip! I asked him whether he had other things to do in my area, but he drove all this way just to see me.

I told him that I wasn’t going to post judge Broomfield’s address and he asked me whether he could “trust” me not to post it.
He also repeatedly assured me that I had done nothing wrong. I told him about Szwak’s postings and he wrote his name down and might even contact him.
And before he left, he gave me a copy of 18 U.S.C.A. section 1028, with the relevant paragraph highlighted for me:
(7) knowingly transfers, possesses, or uses, without lawful authority, a means of identification of another person with the intent to commit, or to aid or abet, or in connection with, any unlawful activity that constitutes a violation of Federal law, or that constitutes a felony under any applicable State or local law; or
Could someone please tell me where I posted that I’m going to publish credit reports so that others go kill them or hurt them in any way?
I just want THEIR personal data published like THEY published MY personal data. I am very reluctant to do that to a judge, after all, I know what it’s like to have to live in fear. I almost cried when I read the article about judge Lefkow in Chicago, submitted to judge Broomfield as exhibit with my motion for reconsideration, I’ll post it tomorrow. Nobody should have to go through that!
But, judge Broomfield did it to me first!
And if nobody STOPS him, he’ll do it again.
Why is judge Broomfield’s quality of life more important than mine?
That’s what I would like to know. I’ve contacted the sheriff and the FBI about harassment and threats I received and they never did anything.
And it sure looks to me like judge Broomfield ought to be prosecuted for refusing to seal my credit reports.
I’m going to ask for a criminal investigation of judge Broomfield, Jones Day, Marc Carlson, Experian and ConsumerInfo.com and David Szwak.
And I couldn’t work after the marshal left.
I had asked him for his card before he left, and he said he didn’t have one. I asked for his name, he hesitated before giving it to me. He said someone named Brett Smith sent him out here, he had never been to my website and really didn’t know what was going on.
But, he also asked all kinds of questions about my neighbors, whether I’m married or have a boyfriend, whether I live alone.
It occurred to me that maybe he wasn’t a marshal at all, but that he was casing my place to rob me or who knows what. I live in the kind of neighborhood where you can’t just park in your car and “observe” without attracting attention from residents who’ll ask whether they can help you with something or maybe even tell you to get lost.
Obviously, they could have called me, sent a letter, a fax, an email.
WHY would you send someone on a 500 mile round trip not even knowing whether I was going to be there?
Then I got an email with the link to an article about the Browns’ conviction, 5 years in prison. They are the people who so far have NOT surrendered to begin their sentence for tax evasion and related “crimes”. The marshals just sent them a letter asking for surrender to avoid another massacre. So now I have to buy guns and ammo and obviously sell my place ASAP, but essentially I have to be ready for anything. I really have no idea what’s really going on. But I do know that they lock you up without pressing charges, without the right to a phone call, and who would I call anyway? I don’t have the money for a good lawyer.
I recently read about someone who got on the no fly list because he wrote an article opposing Bush. It’s all very scary, especially for a long-time pacifist like me.
Tomorrow I’ll start by making some calls to find out whether the guy today really was a marshal and if so, I’ve got a few questions for whoever is in charge of this operation. I suppose it’s mostly intimidation tactics, and it works. Very scary.
And I hope my headache goes away. I hate headaches.
Oh, almost forgot, I installed a “knowledgebase” at Fight Back. It took me forever to get it working. I realized when posting the comments about CreditBoards that I really need to have a place to post summaries and links to my many different projects, lawsuits and documentaries. I have done so much and I have so many sites, even I’m having trouble finding the links. So that will be the outline to my book, but I’ll also post some of the other important things going on, about the Browns, Sibel Edmonds, the 9/11 scam, etc.
And maybe this is a good time to state that as depressing as this all is, I’m not suicidal, and even if I got 2 bullet holes in my head, it wasn’t suicide.

Experian CreditManager alerted to inquiry over 30 days LATE
On MARCH 5 I applied for a mortgage.
On APRIL 7, over a month later, Experian finally sent the notification for the inquiry.
Obviously, there is absolutley NO reason to pay for the Experian Credit Manager to protect yourself from ID theft.
And, do NOT order their Vantage score. If you’re looking for a mortgage, get the FICO scores at myFICO.com. While also defective and flawed with with many known bugs, at least you get the FICO scores required by mortgage lenders.

Court refused to seal the Experian unredacted credit reports until I dismissed all claims
Since I’m already having a horrible day, I might as well finally post about one of my all-time most depressing litigation experiences. For several days I’ve been waking up in the middle of the night, worried about what to do about this, since the deadline for appeal is approaching.
On 8/30/06, Experian and ConsumerInfo.com filed their motions for summary judgment, including numerous UNREDACTED credit reports.
Equifax and Cap One also filed my personal data last year in spring and the court always immediately removed the documents, filed a notice of deficiency and made them redact all personal data when I called. They even found personal data that I missed! They did an excellent job.
However, when I noticed in September that Experian and CIC had filed UNREDACTED reports and I called the court, they refused to do anything and told me that I had to file a motion.
On 9/12/06 I filed my MOTION to Enforce Privacy Rules and to remove Plaintiff’s credit reports. Judge Broomfield ruled:
ORDER granting in part and denying in part 317 Pla’s Motion to Enforce Privacy Rules and to Remove Credit Reports filed by Dft Experian Information Systems. More specifically, it is ordered that Dft Experian Informatin Solution, Inc. redact the month and date of Pla’s birth from exhibits 4 and 5 of the Hughes’ Declaration 316. IT IS FURTHER ORDERED that in all future filings in this action Dft Experian Information Solutions, Inc. shall fully comply with the Manual’s privacy section. IT IS FURTHER ORDERED that Pla’s motion 317 is denied to the extent she is seeking “the indentity of any PACERS users who may have accessed her credit reports”. IT IS FURTHER ORDERED that in all respects Pla’s motion 317 is denied . Signed by Judge Robert C Broomfield on 9/15/06. (LSP) (Entered: 09/18/2006)
I have NO idea why he only ordered the removal of my birth date on TWO reports, several of the reports had ALL my personal data, including drivers license #, birth date, home phone, every address any creditor reported in the last 20+ years, and the first 7 digits of my social security number—and of course all my account data.
I filed a motion for a protective order (denied) and my motion for reconsideration, also denied.
When I got that order, I cried my eyes out and submitted my Notice re Offer to dismiss with prejudice all claims against Experian and ConsumerInfo.com in exchange for removal from public access of all credit reports filed by Experian and CIC.
Of course they accepted and on 3/16/07, the court terminated the case and finally sealed my credit reports. I still have to upload all the filings and exhibits, obviously I couldn’t post about this while my entire credit reports were available for download from PACER at 8 cents/page.
I would like to appeal the orders regarding my credit reports, but I don’t think I can afford another $455 right now. Not to mention that I got enough litigation going as it is.
And I’d also like to file a new suit against the court, Experian, ConsumerInfo.com, Jones Day (I notified one of their partners a few months ago and hoped they’d take some action, which they didn’t) and Marc Carlson. One of my claims against Experian was that they provided my credit data to persons without a permissible purpose. And then they provided my reports to the GENERAL PUBLIC on PACER in order to get me to dismiss my claims.
I have no idea why the court changed its policy in 2006 regarding the filing of personal identifying data, why did I have to file a motion?
Why did judge Broomfield deny my requests to have ALL reports redacted?
What gives anyone the right to file a consumer’s credit report for access by the public?
Can I post Marc Carlson’s, judge Broomfield’s and the Experian and Jones Day executives’ credit reports too?
I’d really like to get a writ of mandamus to require the court to prohibit the filing of any consumer credit reports, in my case it definitely was not necessary to file entire reports and if it IS necessary, they should be filed under seal. But this is all way beyond my legal skills.
Additionally, the court should be ordered to IMMEDIATELY remove all docs containing personal data upon ANY notice, including a phone call. Why should a COURT be allowed to knowingly subject me to ID theft?
I’ll try to post the filings soon—appreciate any suggestions.

Ocwen HARD inquiries for existing mortgage accounts
I just reviewed the reports for a new client who was seriously delinquent with Ocwen and they ran HARD inquiries on 2/5/07, 1/4/07 and 8/16/06.
Wells Fargo also is listed with several hard inquiries, probably for American Services Corporation. One of these inquiries is by Rels Reporting and as I recall, I’ve had a similar problem with them for an investor client about a year ago. Talked to a guy who promised to have Experian fix that, but apparently he didn’t.
It looks like these lenders WANT to put borrowers in foreclosure and they ensure that they’re unable to refinance by destroying their scores with hard inquiries.
Please post or contact me if you sued Ocwen or WF regarding hard inquiries or probably more appropriately, sued EXPERIAN.
