I gave away $2,000
It’s not like I don’t need the $$$, but I won’t sign a settlement that contains a bunch of lies and terms NOT negotiated. I’ll be posting the 9 page agreement Bridge Capital faxed me about 3 PM. Tomorrow morning is mediation. They knew I’d been waiting for their agreement since Monday eve, I had to go to the post-office this afternoon and had been waiting for their fax so I could sign it, fax it back and leave.
They were sure I wouldn’t read the agreement or that I wouldn’t realize how ABSURD their 9-page agreement is. It included numerous references to settling ALL TCPA junk fax claims against them. Hah! So I sent them MY 1-page agreement. I guess they didn’t like it. I can’t get over what scum they are, Bridge Capital General Counsel Shirin Emami tried to trick me. Well, she’s a lawyer ... I might file a complaint with the Bar in California. Her settlement agreement is about as unethical as it gets.

Health One CEO Wes Long affidavit with incorrect date and odd handwriting

Note that the certificate of mailing is dated 8/23, while the affidavit isn’t notarized until 8/27. I used the 27th to calculate how long I had to respond to the Health One motion to dismiss. The judge dismissed Health One on 9/19 for my failure to respond, the day I filed my response.
So I filed my motion for reconsideration, which the judge recently granted. He thought the notary made a typographical error.
It sure is strange that the “27” for the date of the notarization as well as the date of the notary’s commission expiration date do NOT look like they could have been written by the same person. Both the 2 and the 7 look so different.
I used to be a notary in California and there were very strict regulations. Next time I get to the court I’ll check the file with the original.
It sure is also strange that Kenneth Moyer or whoever certified the mailing with Wachtel, Biehn & Malm did NOT notice the date discrepancy.
How could you NOT notice that you’re referencing an affidavit with a FUTURE date when you write the motion and reference the affidavit?

The real tragedy is that the Texas Attorney General Greg Abbott is FULLY aware how this scam works as he already settled his suit against some of these scammers and explicitly allowed them to CONTINUE to scam. He even allowed the illegal junk faxing!!!
Why is he so evil?
Texas is the health insurance fraud cesspool just like California is the mortgage fraud cesspool and it’s good for the states’ economies to bring in all that cash by DEFRAUDING consumers in the rest of the country.

Corporate looter American Home Loans (CBSK Financial) battles for the junk faxers
I had NOT planned on writing a 9-page letter to the CBSK attorney Amy Schwartz, with Beaugureau, Zukowski & Hancock in Phoenix. The longer I looked at their filings, disclosures and discovery responses, the angrier I got.

It is astounding that the *people* who run these corporations have no shame.
CBSK attorney Russell Grandy declined my offer to team up against the lead generator and faxer Keith Hyatt, owner InfaSource. It’s a lot more profitable to continue to have agents violate the SHAM policy while looking the other way and cheerfully closing the illegally obtained loans.
And instead of taking action against the agent who supposedly violated their policy and against the faxers, they spent thousand of dollars on fighting my claims and protecting the guilty.
I had offered to settle for $3,000 early this year. How much are they going to spend on legal fees fighting me?
It is awfully depressing to watch the footage of the looting in New Orleans—but, I can come up with a gazillion excuses for the looters. I’m sure there are some criminals, but for the most part, I see people under a tremendous amount of stress in total anarchy and chaos. I heard that over 35% of the people live(d) in poverty.
What’s the excuse of the thugs at American Home Loans?
Chronic greed? Lobotomy?
Why isn’t the “national guard” going after those looters?
The economy will self-destruct exactly like New Orleans. The problem wasn’t Kartrina, but the REFUSAL to resolve known problems.
The mortgages originated due to these false and misleading junk fax advertisements are contributing to the absurd increase in housing prices and will cause a lot of suffering and foreclosures. Ultimately, they’ll greatly contribute to the collapse of the housing market - the ONLY thing that’s been keeping the economy going. EVERYBODY with half a brain knows it.
Nobody does anything.

According to the discovery responses, CBSK is a closely held corporation and they’re concerned with the privacy of the major shareholders and officers. I haven’t had time yet to look into who they are, please post or email if you have any info.

“Vardan Kushnir, notorious for sending spam to each and every citizen of Russia who appeared to have an e-mail, was found dead in his Moscow apartment on Sunday, Interfax reported Monday. He died after suffering repeated blows to the head.
Kushnir, 35, headed the English learning centers the Center for American English, the New York English Centre and the Centre for Spoken English, all known to have aggressive Internet advertising policies in which millions of e-mails were sent every day.
In the past angry Internet users have targeted the American English centre by publishing the Center’s telephone numbers anywhere on the Web to provoke telephone calls. The Center’s telephone was advertised as a contact number for cheap sex services, or bargain real estate sales.
Another attack involved hundreds of people making phone calls to the American English Center and sending it numerous e-mails back, but Vardan Kushnir remained sure of his right to spam, saying it was what e-mails were for.
Under Russian law, spamming is not considered illegal, although lawmakers are working on legal projects that could protect Russian Internet users like they do in Europe and the U.S.”
And now you know why so many people want to come to Europe and America: they have NO clue. Not only are we not protected from spam, but the government and courts protect even the most vile outfits like Ameriquest when they hire spammers engaging in totally illegal spamming. These lowlife spammers rarely can be identified and even when I served the corporation, they didn’t answer. I didn’t even bother to get the worthless default judgment.
People in other countries and especially countries with a lower standard of living think that we are “protected” from all the evils and they don’t know that the “first world” civilizations are in a rapid decline. They have no idea that the corrupt American government and corporations makes the Russian Mafia look like Sunday school.
They don’t know that the American justice system is based on lies. The best liar (lawyer) wins.
They don’t know that our legislators sell out the rights of the people to the corporations, so they can maximize their profits.
They don’t know that we have a credit scoring system designed to allow creditors to increase rates for no reason other than a low score. A system that can lower the scores after deletion of the only derogatory account. A system that allows lowering the score after the bankruptcy is finally deleted 10 years after the filing. Yup, the score dropped from 637 to 587.
Maybe something good came out of Vardan’s spam, maybe some Russians actually learned English and find the truth about America on the web. And hopefully they’ll realize that becoming like the US is NOT a good thing.
