Ameriquest Mortgage Motion to Dismiss - INCOMPETENCE BEYOND BELIEF!
It is surreal!
Ameriquest admits to purchasing my “application” from “Lead Jungle.” Notably, they don’t say who or what Lead Jungle is.
BOTH violate numerous requirements of the CAN-SPAM Act. Since the AZ spam legislation is preempted by the CAN-SPAM Act, I don’t have a private right to sue.
However, due to the numerous violations of the CAN-SPAM Act and Ameriquest’s extraordinary incompetence as well as their FINANCING the SPAMMERS, I’ll forward my complaint to the AZ AG. And since Ameriquest is a national company, I’ll also send it to the FTC. The legislators who preempted state law ought to get a copy too.
And of course two press releases are a high priority, one about their SPAMMING and the other about their unsurpassable mortgage incompetence.
Beatrice passed my info on to Jonathan with SouthWest Mortgage because Ameriquest couldn’t provide me with the best rates, yet they claim that they declined my application because I failed to respond to their Notice of Incompleteness.
Ameriquest ADMITS they sent this Notice of Incompleteness AFTER they already provided Jonathan with my info.
Now that I reviewed the purchased application, it is becoming clear to me that I was NOT declined for the loan I applied for with Beatrice.
I do NOT own a $225K home in Cottonwood with a $200K loan that I want to refinance.
And that’s what I told Beatrice when I applied to be PRE-APPROVED for a PURCHASE.
I also told her that I’m self employed and that this is why I needed to get my credit reports with FICO scores - which she agreed to send to me and failed to do.
All that is of course in the complaint.
Did I mention in the complaint that I have the RECORDINGS of all my calls with Beatrice as well as Jonathan?
I just love it! This is going to be SO good.

Ameriquest Mortgage accepted the Waiver
Jeffrey Messing with Poli & Ball in Phoenix sent the Waiver today.
Can’t wait to see what they file, especially about the SPAMMING. I think I’m getting 15 - 20 mortgage SPAMS per day now. Many of them with deceptive subjects such as “Notification of Payment” or “Notice of payment decline” or “Account Activation”—the kind of stuff that makes me undelete and really read it.

Naming Ameriquest Mortgage in my new complaint
I am FURIOUS!Got my mail again yesterday, and instead of my credit report with the FICO scores I have an idiotic "Notification of Incompleteness" from Ameriquest.
Those stupid morons are asking for my paystubs, W-2s and proof of hazard/flood insurance.
Before I even gave Beatrice my SSN I told her that I was selfemployed and was looking for a PREQUAL. I also told her that I was looking for my credit report with the FICO scores and that TU and Equifax weren't releasing my file to me and she assured me that she would immediately send me the reports.
All I got was their idiotic notification, and a call from some other broker. According to Beatrice, they couldn't help me. Where is my adverse action letter?
On top of that, they engage in SPAMMING!
Ameriquest Mortgage ought to be shut down.
Anyway, here is some of the info required to sue them:
