I never thought I’d see the day when a major American corporation and their lawyers go on the public record to proclaim that it’s BAD to care about others.

Are these “human beings” (if that’s what they are) lacking any conscience and compassion?

Or are they just plain evil?

They don’t deny that they all know that Capital One’s refusal to report the credit limits ruins innocent peoples’ lives and even kills. 

Yet, they do NOTHING to stop the exploitation of the disadvantaged.

I have been so incredibly busy, I barely had time for a quick look at the memorandum and exhibits and I am totally floored.  Once again my thoughts about many of the planet’s problems are memorialized on the public record as the defendants’ exhibits.  Since the Cap One exhibits are very difficult to read, I’ll try to post the links to my postings and pages tonight.

Capital One keeps whining about my postings, yet they have NEVER notified me of any incorrect defamatory statements.

Why don’t they submit their listing of URLs with specific false defamatory statements and their request for correction?  Of course that’s because they KNOW that everything I published is either true or my opinion. 

They KNOW that they LIED to the court.

Since they are such dedicated readers, they should know that I will publish their request and I WILL post corrections and apologies for any false statements.

And I’ll sure appreciate your thoughts on WHY you don’t care how many people suffer and ultimately die because of Capital One’s refusal to report the credit limits.

Their itemized accounting for their expenses is a very interesting read and it shows how much I have put into this litigation.  A filing that takes the lawyers a few minutes requires many hours of research for someone like me with absolutely no legal background and no funds to pay for legal advice. 

I noticed the many Capital One consultations with Target and other defendants’ lawyers and their reviews of my websites and filings.  I must have spent thousands of hours communicating with other consumer litigants and reading their filings.

I recently had a LONG talk with someone who urged me to contact 60 Minutes and to write a book and he offered to put me in touch with people who can make it happen.

I really don’t have the time or desire to go on TV.

Publicity and the subsequent many e-mails from people pleading for help is not only extremely time consuming, but also very depressing.  It’s very hard for me to advise readers in foreclosure to not bother suing or looking for an attorney unless they are wealthy.  I could not possibly mislead people into thinking that they will prevail in an American court just because they’re right.

On the other hand, my publications related to my litigation have made a difference and criminals like the Hand - Cerami clan who engineered the Wellstone Filters stock fraud (was WLSF, now WFLT) are now just about out of business.  Of course the SEC did NOTHING and failed to seize their assets to at least partially reimburse the defrauded investors—despite my repeated requests.

My Wellstone press release was accessed over 172,000 times and the Target press release was accessed over 100,000 times—and that’s just at ONE distribution site.  I don’t have time to check all the logs and no way to get the stats from the many sites who reposted the releases.

The litigation against Target was a partial success.

I got a check and they have been correcting the credit limits in response to readers’ and clients’ disputes with CRAs, but they haven’t included it in their regular reporting.

In light of the election results this week, it might be worth the effort to contact every legislator in Washington and request their comments regarding the Capital One refusal to report the credit LIMITS.

I really don’t think that there’s much of a difference between Republicans and Democrats, but if nothing else, it would document which legislators care about the people who elected them or whether the next campaign contributions from Capital One and the finance industry are more important.

Maybe somebody could explain to me why “Capital One Financial” is listed as recipient.  And of course these few thousand dollars listed at Opensecrets.org aren’t the extent of the Capital One influence peddling.

I really wish I wasn’t so incredibly busy and broke—building a house takes up all my time and money. Due to health issues (I thought I was going to die last winter) I needed to get away from the computer and stress and I feel SO much better now.  I’d love to do nothing but build houses, it’s so cool and tremendously satisfying to know that I can now build my own house literally by myself.  It would have to be a small house if I had to stand up the walls by myself and it would take a long time, but I could do it - from the foundation to the roof, electrical, plumbing, septic, ...

And then there’s knowing that while I’m having fun building my house, millions are SUFFERING for no reason other than to increase the Capital One profits and the Fairbanks’ wealth.

Of course I also know that whatever I do to help others will ultimately help me if it includes CHANGES in corporate practices and laws—I’m only a consumer and I am continually subjected to fraud and deceit by Corporate America.  Not a month goes by when I shouldn’t file another lawsuit - but I can’t because I don’t have the time, money and legal skills.

So I sincerely thank Capital One and their attorney Michelle J. Roddy for motivating me to once again focus on more than my immediate personal interests.

Due to my financial situation, it’s hard for me to make time, but since I have to write a reply to their memorandum anyway, I’ll send out a press release about the appeal and the attorneys fees.

And if anyone is interested in DOING something other than ranting and complaining (either commit time or cash), such as conducting a fax campaign to the Senators and Representatives and especially to follow up and DOCUMENT the results, please post or contact me.  I get several hundred SPAMS every day, so please put CAPITAL ONE in your email subject.
