Judge Neil W. Wake dismissed ALL my claims against Trans Union and Verifacts
5/25/10: Arizona federal judge Neil W. Wake once again DISMISSED all my claims.

Judge Wake is appointed for LIFE and there is NOTHING anyone can do other than to hope for the collapse of this corrupt system. Of course judge Wake is NOT the only corrupt judge, we have only a FEW honest and competent judges and attorneys in America.
If you have to go to court, chances are, chances are you’ll get railroaded like EVERY consumer I know who litigated in federal court against credit bureaus without an attorney UNLESS you can settle BEFORE these crooks in robes get a chance to dismiss.
I know that many people depend on their credit rating and LIVE on credit, but I find that in many cases, it’s simply not worth the aggravation and EXPENSE to try to maintain ACCURATE credit reports. With a little PLANNING you can minimize the impact of collections on your life.
The corrupt American legal system does NOT provide for any compensation for our time wasted on litigation.
When judge Wake HAD to award sanctions against Focus Receivables in previous litigation, he limited the amount of my sanctions to my travel costs. I lost two days PLUS the many hours I tried to get the Focus attorney to provide discovery answers. I had to file THREE motions. Not to mention the aggravation when judge Wake denied my first two motions to compel.
The corporate attorneys KNOW that they can do whatever they want and and they can try to bankrupt you with impunity. If you have a full-time job, you’ll be spending all your free time researching and trying to figure out what to do.
So I did NOT bother to amend my complaint as judge Wake permitted for two of my claims. I have better things to do with my time AND I already know that he will DISMISS my claims again. Trans Union OWNS the Phoenix federal court. Unless you’re WEALTHY and you can PAY a COMPETENT attorney, you’re SCREWED.
Interestingly, I recently noticed that Arizona attorney Bybee no longer looks for FCRA cases and he seems to only go after collectors now. Last year Trans Union attached the dismissal of one of his cases as exhibit.
The credit bureaus have essentially UNLIMITED funds for litigation and an attorney without the backing of a WELL FUNDED firm really doesn’t have a chance in the HOSTILE Phoenix court.
What are your options?

If you’re one of the MANY (near) judgment-proof Americans with large unsecured debts, STOP paying the national banks and take care of yourself and your friends and family instead of contributing to record profits for criminal bankers. Yes, the credit bureaus’ and collectors’ vile misconduct kills people, but so do pesticides, chemical fertilizers, GMO food, high fructose corn syrup, Aspartame, MSG, factory farming, etc. etc. etc.
I can’t MAKE the credit bureaus comply with the law and I can’t make judges use common sense and be fair, but I CAN grow my own organic food and I CAN try to educate others.
Recently one of my LONG time clients contacted me again. She’s back to chemo.
Yes, I got her credit where it SHOULD be and she even got a couple thousand from her mortgage lender for incorrect credit reporting. But I can’t help but wonder whether the STRESS inflicted by Trans Union when they REPEATEDLY deleted the DATE CLOSED from their discharged Capital One account caused the cancer. The scores dropped about 80 FICO points every time while they were trying to finance a home.
She didn’t sue Trans Union and was happy to finally purchase a home.
Last week she wrote:
… Plummeting property values. Unable to sell. I vividly remember, back in 2006, when you made the case that renting is not so bad… You were so right on!!!
I wish I could have convinced her NOT to buy. We have over 2500 postings in her private forum! We both worked so hard to get her and her husband the credit they deserved. All for nothing and maybe LESS than nothing. If I hadn’t “helped” her, maybe they would NOT have purchased a house. Maybe she would NOT have cancer.
It sure sucks to realize that I wasted so many years helping clients increase their FICO scores, documenting and publishing so many systemic problems and becoming the most knowledgeable and experienced FICO scoring expert. What for?
The credit bureaus know that they own Congress, the courts and MOST consumer attorneys. Just like BP, they have no worries. It simply does not matter how negligent the credit bureaus are, they are now more powerful than ever. I recently posted about my frustration that NOBODY cares about the FICO scoring bugs and FICTITIOUS late payments I documented THREE YEARS ago!
I’ve been meaning to set up blogs about the Verifacts illegal collection tactics and the TrueCredit credit report fraud. I meant to finish a blog about LVNV. I meant to update the blog about my client’s FTC complaint about Experian. I meant to submit my complaint about FDRS to Cal AG Jerry Brown. I meant to submit my own complaints about Verifacts and TrueCredit/Trans Union to regulators.
I’m busy, it doesn’t pay and my accomplishments are limited to providing MORE documentation of the CORRUPTION of the entire system.
I ENJOY gardening and building and I live a much healthier lifestyle.
I will continue to publicize systemic credit reporting, scoring and collection issues AS TIME PERMITS (and as supported by donations and paying clients) at Liars and Cheats EXPOSED! .
Unfortunately, my corruption documentaries won’t change our system, but I hope that many of you will realize that your taxes finance this corrupt system and that there ARE alternatives.
NOW is the time to seriously consider making some changes.
