The Experian and ConsumerInfo.com discovery responses
I really don’t get the discovery process and all these objections. I’m going to have to depose Kimberly Hughes, the Experian “Consumer Affairs Specialist” who signed for the Experian responses and supplied the declarations for Capital One and American Agencies.
Ms. Hughes doesn’t know what the “credit limit” is in the context of credit reporting and did not provide a single meaningful response.
She signed the verification under penalty of perjury under the laws of the State of CALIFORNIA in Allen, Texas and that she is “informed and believes” .... this is so much BS. Lies, lies and more lies.
I suppose I’ll be going on a road trip to Texas for the depo, hopefully in a few weeks.
I wrote to the new Experian attorney Marc Carlson on 4/4/06:
… I have some issues with the Experian responses to my requests, but I’ll be busy until later this week. Maybe we can schedule a phone call or I can e-mail you the issues.
Please let me know what you prefer.

Just as with my discovery questions, it appears that I’m unable to communicate anything. I didn’t get a response.
The correspondence with Experian
So I’ll try this one more time. I really don’t appreciate being ignored. I’ve heard that this is not unusual with Experian. Are so many consumers taking my advice and suing? Or it’s just Experian’s way to wear litigants out?
I don’t care what it takes to get answers, I’ll gladly spend $2,000/day for the video depos and rephrase my questions and explain terms like “credit limit” until she gets it. It’s a disgrace that apparently she is the “most qualified” person at Experian and I’ll be very upset if I travel all the way to Texas and spend that kind of money to find that she’s a clueless bimbo who just signs whatever the attorneys send her. Of course ultimately Experian should be footing the bill, but I have only so much cash.
The NACA attorneys so sold out. I sure wish I had just a bit of a clue about discovery and objections, but the discovery responses and video depos should at least provide a good starting point for all you consumer litigants.
I have no verification for the CIC responses, so I don’t even know who to depose.
