TCPA complaint against Dana Smith, Dana Capital Group, Homeowners’ Friend, Joseph Hendricksen
This is a very interesting complaint.
Attorney Stacy Allen was on the do-not-call list and got several hangup calls from 714-692-6900—the number for Homeowners’ Friend. She spoke to the manager Joseph Hendricksen who promptly accused her of extortion.
During subsequent communications, Hendrickson provided the (800) 400-4046 ext 106 as a call back number.
“15. On or about January 7, 2005, Allen received a call from someone who identified herself as Amanda Smith, a paralegal for Dana Capital. In the conversation, Smith acknowledged that she had “had some problems with Hendricksen” on which she did not elaborate. Allen conveyed her demand for a global settlement, which included a contribution from Hendricksen for his abusive conduct.
16. On January 10, 2005, an attorney by the name of Daniel Nassie who said he represented Dana Capital. Allen discussed her claims, and requested that he convey the demand to his client. The following day, Nassie called back and reiterated an offer that did not include Hendricksen. Allen declined the offer.”
Stacy Allen’s claims include TCPA, libel and slander (the extortion accusation).

Dana Capital Group - the illegal marketing king!
Lately I can’t believe what I’m hearing. Every time I call on a mortgage junk fax, it’s some mortgage company doing the California loans and Dana Capital Group does the loans outside California.
1) First it turned out that “Mortgage Center” (became themortgagestar.com and now ???) processed loans for Dana Capital and used the Dana Capital credit bureau account to obtain consumer credit reports.
After first operating out of Phoenix, “Mortgage Center” moved to Chino, Cal. (near San Bernardino) and apparently they’re the undercover branch of Pacific West Mortgage. I had a long talk with broker Nanadiego who knows that they’re faxing, had told them to quit, but apparently he doesn’t have a lot of authority. Pacific West does the California loans, Dana Capital gets the out of state loans.
Dana Capital’s Amanda Smith lied all the way and their attorney still doesn’t want to acknowledge the relationship with “Mortgage Center.”
What is the relationship between Dana Smith (owner) and Amanda Smith (Legal Dept. Coordinator)?
I didn’t get a good settlement offer and as I was looking at that Dana situation some more I realized that they had no permissible purpose to run my credit - since they claim to have nothing to do with “Mortgage Center.”
It upsets me when people and especially corporate execs and lawyers lie to me. So after NCO ignored my request for investigation, I demanded my $1,000 from NCO, who had sold my credit report to Dana Capital. I’ve had my dealings with NCO on behalf of clients and they’ve always been hellish to deal with, but this time they really outdid themselves.
NCO returned all the documentation I had sent to them (my DRE complaint, correspondence with Dana, etc.) and demanded that I provide them with my SSN and info about the original creditor. NCO started to collect an entirely fictitious debt instead of shutting off the Dana Capital access to credit reports. And of course they didn’t send me my $1,000 for statutory damages.
So last Saturday I put the packages together for the CRAs, requesting that they terminate the NCO and Dana Capital Group access to credit reports.
We shall see what happens, if the CRAs don’t terminate them I’ll sue for running my credit without a permissible purpose. The CRAs also have an obligation to ensure that they resell consumer credit reports only to reliable and trustworthy companies, not scummy outfits like Dana Capital and NCO who totally ignored my complaints and couldn’t care less which criminals have my credit report.
Ok - sorry, I just have a thing about ID theft and privacy.
2) In January I got a mortgage junk fax for Help-U-Finance and just like Pacific West Mortgage, they do the California loans and Dana Capital does the out of state loans.
3) Today I got another mortgage fax and I was transferred to People’s Home Loans, and as you by now expect, they do the California loans and Dana Capital does the out of state loans.
Since Michael Aviles at People’s Home Loans covered for the faxers and then hung up on me, I did a little research - looks like another scummy outfit on all levels.
Robert Cirelli somehow got my phone # (he wasn’t the agent I had spoken with) and he left a message for me from “Peoples’ Home Loans / Dana Capital” When my e-mail inquiring about his license status bounced (I didn’t find a license at the DRE site), I called the cell # listed at the People’s Home Loan website. His announcement was for ”American Residential Funding / Dana Capital.”
Summary: Dana Capital has these arrangements with a number of mortgage companies to get all the out-of-state loans. When they get a lead, they ask where the property is and that’s how they determine which company’s credit report account to use. To do the loan, the right mortgage broker has to be named on the credit report.
Dana Capital set up at least one corporation with a similar name and ignored my request for an explanation. They probably want at least one other corporation to fall back on if they run into serious legal trouble with the main corporation or they’ll use the new corporation to get the judgments against and then this corporation owns nothing.
Maybe it’s just a scam to throw off some of the TCPA litigants - but Dana Capital definitely took steps to ensure that they have a 2nd licensed mortgage company with almost the same name and address: Dana Capital Group of Arizona.
It really sucks to know that you could be applying with any lender, research them and be comfortable with their reputation, and then you end up at a scummy outfit like Dana Capital - and there’s nothing you can do about it.
Well, I hope this summary makes sense, this is the very short version. At the Mortgage junk fax forum is a lot of my correspondence with the legal departments and attorneys and my research, my DRE and banking department complaints, the VM’s from the loan agents, the junk faxes, etc.
People’s Home Loans is currently in the “Mortgage Services” topic because the fax header ties in with them.

People’s Home Loan for Dana Capital junk fax from “Mortgage Services”
This fax got my attention:
The header states that it is from “Mortgage Services” at 312-264-4490 and I have a bunch of these faxes with that number from last year. When I called they identified themselves as “Mortgage Services” and I thought they were the mortgage company.
By the time I figured out that they were most likely just a call center, the toll-free numbers weren’t working in my area anymore and I couldn’t ID the mortgage companies. I finally sent my complaint to the DRE.
So I called and got to a So Cal call center and I was transferred to People’s Home Loans.
“As usually”, I was told that California loans are originated by them and out of state loans go to Dana Capital.
Dana Capital just doesn’t quit. It seems like they have a lead generation agreement with every scummy mortgage broker in California.
The junk fax, my research and my fax to People’s Home Loan
I called Michael Aviles, the office manager and asked who gets the leads for them. He asked me what the number on the fax was, I gave him the 800-513-7420, he told me that I need to call them. Oh so clever— NOT! They are obviously aware that the faxes are illegal, Michael Aviles admitted that he is involved in the lead generation. When I asked him for his fax number he hung up on me.
Am I going to be suing every broker in Southern California? It sure looks like it.
I just sent them this fax/e-mail and I don’t expect to hear from them.

CBSK - AHL attorney Russel Grandy’s comments to be included in the press release
It looks like Mr. Grandy’s contribution to the press release will be something like:
“In response to Ms. Baker’s request for comments to be included in this press release, Russell D. Grandy, attorney for American Home Loans, dba CBSK, stated categorically that Ms. Baker is totally wrong, misconstrued and misinterpreted his statements and that he did not want to take the time to go over each erroneous point.”
It’s amazing that they don’t try a little harder to represent themselves more positive. I guess it’s cheaper to order more illegally obtained leads than to take the time to provide a specific response to ensure an accurate representation of the facts in the press release.
Could it be that Mr. Grady really is not taking the time to be specific because there is *nothing* wrong in my call summary?
I’m hoping that with enough publicity many people will sue, I’ll be happy to provide to litigants an affidivit declaring that my call in response to the fax was transferred to AHL’s Bob Molnar.
Only when the cost of litigation exceeds the profits from the illegal marketing will they stop the illegal marketing.
I’m also going to submit my complaint to the DRE about the CBSK illegal marketing and especially their failure to report the agents who supposedly ordered the illegal marketing. At this point, I’m beginning to wonder if in fact it is the agents who are responsible and if CBSK ever fired anyone for illegal marketing.
It will probably be a couple weeks until I get the press release out, just got over a cold/flu and now I got an eye infection.
So much to do ... but I’ll definitely do whatever I can to expose the junk faxers. The Dana Capital press release was accessed at PRweb 74,000 times, Ameriquest 65,000 times, with over 2,000 media pickups each. There is a lot of interest in how mortgage companies do business.

Dana Capital sued for using illegal auto-dialers - attorney seeking others for class action

This company uses an auto-dialer to call on people to get them to re-finance. Too bad I didn’t figure this out when it started, but after the 12th hangup, I investigated the number using a criss cross directory, and sent a letter to them stating the violations I could prove amounted to $3,500.00 in statutory damages under the TCPA. In the meantime, they kept calling until I picked up the phone and announced who they were, which flustered the caller. I demanded to speak with a Manager, and then was speaking with “joe” who claimed to be a manager. When I informed “Joe” that his company’s violations amounted to $3,500.00 he “accused me of trying to extor money from the company”, which, to an attorney, is a serious matter.
I am suing them, and contemplating a class action. If anyone out there has experienced the same problem with this company or any other company violating the prohibition on auto dialers (they are disallowed for marketing purposes, as are auto fax dialers), I would be happy to give counsel

I’m aware that others have sued and settled with Dana Capital for these types of violations. Apparently the cost of settlements is less than the profits from the calls.

My factual summary and announcement of press release to attorney Russell Grandy, CBSK aka AHL
I’ve been talking to Russell Grandy, CBSK aka American Home Loans attorney, for about a week and he assured me that they were absolutely against junk faxes and that he never wants to have to talk to another person like me to have to settle these claims.
Well, I’m going to make sure that the word about CBSK gets out and here’s my e-mail to ensure that I’ve got the facts straight for the press release.

Let me start by apologizing for being so naive, I was very gullible and actually believed that CBSK is doing whatever it can to ensure that nobody orders junk fax leads. I guess you offered me only $500 because I came off as a little on the stupid side, immediately offering to release you from my claims for only $3,000.
My offer to settle with CBSK (American Home Loans) for $3,000 is hereby rescinded and I am now seeking $12,000 + costs and any other relief I’m entitled to from CBSK and the other defendants, jointly and severally.
It is time for a press release to give the rest of the world a badly needed clue about CBSK and its marketing and business practices.
Of course I want to be sure that the release is accurate and I’m sending you this e-mail so that you have the opportunity to correct any misunderstandings.
1) I received 4 junk faxes advertising mortgage rates, unsolicited and with header violations, and my calls were answered by Keith Hyatt’s call center.
2) One of my calls was transferred to Robert Molnar, CBSK branch manager.
3) You stated that Molnar resigned in mid January and that you would have fired him if he was still employed.
4) You stated that you would not provide me with Molnar’s address even if requested through discovery to protect his privacy.
5) You don’t actually know that Molnar arranged to purchase the leads, the person responsible could be another CBSK employee or officer.
6) CBSK was served on 1/6/05, prior to Molnar’s resignation, and as of 2/2/05 nobody had investigated who ordered the leads and CBSK does not intend to investigate, sue the fax broadcaster or take any other action to determine what exactly happened and ensure that the responsible parties will at least be identified.
7) CBSK has settled numerous junk fax claims.
8) CBSK has no written agreement with its agents to ensure that all agents know that it is not only illegal to purchase mortgage leads, but that they may be liable for many thousands of dollars in damages.
9) CBSK does not advise its agents that it will report any illegal marketing to the DRE for disciplinary action.
10) Despite the junk fax (and other illegal marketing) settlements, CBSK has never reported a licensee to the DRE for disciplinary action as required by law.
11) The DRE Regulations and Law as of 1/05 at http://www.dre.ca.gov/relaw_pdf/Regs.pdf:
“2725. Broker Supervision.
A broker shall exercise reasonable supervision over the activities of his or her salespersons. Reasonable supervision includes, as appropriate, the establishment of policies, rules, procedures and systems to review, oversee, inspect and manage:
(e) Advertising of any service for which a license is required.”

“Broker Must Report Discharge of Salesperson for Violation
10178. When any real estate salesman is discharged by his employer for a violation of any of the provisions of this article prescribing a ground for disciplinary action, a certified written statement of the facts with reference thereto shall be filed forthwith with the commissioner by the employer and if the employer fails to notify the commissioner as required by this section, the commissioner may temporarily suspend or permanently revoke the real estate license of the employer, in accordance with the provisions of this part relating to hearings.”
The advertisement of mortgages requires a license and these 4 junk faxes violated numerous provisions of the DRE advertising guidelines.
I believe that these are the points we can agree on, please let me know if I misunderstood anything. The following are my conclusions:
While CBSK pretends to not condone the purchase of illegal mortgage leads, it has done absolutely NOTHING other than to fire employees for violating this policy after a suit was filed against CBSK.
The reason for CBSK’s disinterest is obvious: CBSK profits from the illegal marketing.
How many employees have actually been fired?
How many loans did Molnar close from junk fax leads?
How much did CBSK make on those loans?
How many other CBSK agents received and CONTINUE to receive leads through illegal marketing?
I looked up Molnar at the DRE, and as of 2/4/05 he’s still licensed with CBSK with NO disciplinary action.

I tried to call the DRE to find out why it takes several weeks for them to update the records, but I could not get through. So *I* will take the time to report Molnar’s illegal marketing (since CBSK NEVER reports any illegal activities by its agents despite the legal requirement to do so) and I’ll see where that goes.
Of course I can name Molnar in my suit, but I’m definitely looking for a judgment against all parties involved, jointly and severally. Your repeated assurances that I can recover the difference between the $12,000 and the $500 you offered by litigating against Molnar and the broadcaster were such an eye opener.
You failed to mention that a California real estate broker such as CBSK is liable for its agents’ actions.
Generally every employer is liable for the employees’ work related actions, but the real estate law is especially explicit.
I suppose you think it’s the right thing to do to mislead a pro se litigant and to save CBSK a few thousand bucks. Well, that backfired. And you can’t say that you didn’t know what I’m doing and why - you had my cover letter with the summons and my previous e-mail. Do you think all people are liars like the corporate scumbag lawyers?

Now please explain to me why it is extortion to ask for what’s been routinely awarded by the courts?
Of course you argue that CBSK did not know about the junk faxes, but that’s not a convincing argument to me.
CBSK did NOT even report agents who ordered leads in violation of the law to the DRE and instead SETTLED the other claims in order to avoid having to take any action.
As I told you, MY motivation isn’t just money. Plaintiff’s attorneys may not appreciate this, but I am sincere about wanting to STOP the mortgage junk faxes. It’s not just about my resources and statutory damages, it’s about the FACT that people who engage in illegal marketing also engage in other illegal activities, such as low quoting, changing the rates and fees at closing, etc.
I have hundreds of e-mails from consumers pleading with me to help them because their lender lied to them. Even if I was an attorney, there is nothing I could do for them - they can’t prove the lies. Many end up with serious financial problems, become depressed and suicidal and/or get divorced. To you it’s all about money, to me it’s about changing the mortgage business.
So now I’m taking a different approach, a mix of litigation, publication and complaints with regulatory agencies. I am very unhappy with the lack of enforcement by the DRE - are they just overwhelmed with complaints or are they on the payroll too? I hope to find out.
This is an open letter, posted at my websites, in the spirit of sharing my CBSK experience. I hope that many others will sue CBSK and will file DRE complaints, hopefully consumers will NOT get their loans from such a corrupt company and maybe one day my publications will cost CBSK so much money that the decision makers will find it more cost effective to comply with the law.
That’s why I don’t mind going through discovery, finding out what’s REALLY going on at CBSK and sharing the information on the web.

I am very glad you wrote! Although I’m perplexed because your letter states that you also faxed it and I didn’t receive the fax.
All I can find in the logs is a hangup call from 714-641-5100 on 1/12/2005 at 3:31:09 PM - which seems to be your telephone #. Am I not getting the “real” faxes?
I sure don’t have a problem receiving the junk!
Please let me know whether you really faxed your letter, when and to which number so that I can check into this.
Please accept my apologies for the late reply, unfortunately I don’t enjoy the luxury of postal delivery, so I received your letter last week just before my hard drive crashed and I’ve been very busy.
However, on 12/14/04 I had sent e-mail to your client Keith Hyatt, and when I received no response, I had faxed my request for review of my publications relating to your client on 12/23/04 to Larry Cerutti, partner at Rutan & Tucker.
Did they not get my email and fax and that’s why they didn’t they respond?
While the Dana Capital press release contained only a few paragraphs about Mr. Hyatt’s activities and your firm, I am now getting ready to dedicate an entire release to Mr. Hyatt, Laura Archer, Prime One Financial, Leads To Results, etc. and the people in charge. As always, I strive for accuracy in my publications.
The issues:
1) I am suing Mr. Hyatt not as officer or owner of Infasource and Leads To Results, but as an individual involved with the illegal faxing. Therefore, Infasource, Leads to Results and Mr. Hyatt are liable under the TCPA.
2) You stated that Mr. Hyatt does not own Leads To Results, Inc. I apologize for my apparently erroneous conclusion that he owns Leads to Results, Inc. because he is still listed as its registered agent at 7700 Irvine Center Drive Ste 220 as of today.
a) You wrote that Mr. Hyatt was no longer employed since “at least September 7, 2004.” Please provide a description of you client’s duties at Leads To Results.
b) How do I serve Leads To Results? I don’t understand how your client can be the registered agent at their address when he hasn’t been an employee for over 4 months and presumably is no longer at that address.
3) Your client personally provided me with the 800-853-2393 and now you claim he does not own this number. Did I misunderstand, does he own a similar number?
4) You claim that I registered for junk faxes. Is this your idea of a joke?
Nobody ever “registers” a number to receive mortgage junk faxes. Your absurd claim may well be the reason for the FCC ruling requiring that junk faxers need to obtain written permission prior to faxing.
Please provide me with those records you claim to have so that I can sue the person who fraudulently “registered” me to receive junk faxes and I also need to file an ID Theft complaint with the police. Please provide me with the exact process to register for your client’s junk faxes. Should the Deputy contact Mr. Hyatt about this matter?
Last time I filed an ID Theft complaint, the Deputy wouldn’t investigate because I didn’t have the names and contact info for the people/companies involved and I’ll greatly appreciate your cooperation.
I was subjected to ID Theft last spring and I am extremely concerned.
5) You wrote that Hyatt has not engaged in the conduct asserted in my complaint and that he is prepared to execute a declaration stating so under penalty of perjury.
Mr. Hornak, I will dismiss your client from this action as soon as I have the original notarized declaration stating under penalty of perjury that he never had anything to do with the sending of unsolicited faxes, including during his employment with Leads to Results.
I don’t know how it can be that your client admitted to me on the phone that he has sent the faxes, maybe someone impersonated him too?
Isn’t it amazing how *somebody* pretended to be me and registered me to receive junk faxes and *somebody* pretended to be your client and gave me an incorrect phone number, admitted to the faxing and provided me with Larry Cerutti’s name and address as his attorney!!!!
If this is really true, would you please consider representing both me and Mr. Hyatt so that we can go after these unscrupulous imposters and share the associated legal fees?
With respect to your complaint about my publishing that Premserv Mortgage and others share the offices with Leads to Results, I obtained this information from public records and I see no reason to remove it.
Apparently you don’t understand the purpose of my publications - to expose the scumbags AND the corporations and people who associate and do business with the scumbags. If they don’t like being mentioned in the same sentence with the scumbags, they ought to move out - or kick out the scumbags - whatever works for them.
I’m a big fan of personal responsibility and since the regulators and courts are really not doing their job and everything takes forever and scumbags merely start new corporations to continue with their illegal activities, this is a much more effective way to at least isolate the scumbags and help other litigants by sharing my research.
Mr. Hornak, I you feel the need to sue me for defamation or anything else, please don’t bother to pay to have me served. I will certainly accept the waiver of service, you can just fax it to me.
I’m looking forward to take this matter wherever you like to take it - dismissal of your client or your choice of court and location - it’s your and your client’s call. I hope to hear from you soon.

When I called the 800-701-9975 on the fax, I was transferred to Help-U-Finance.
I spoke with loan agent Alan Nagi, but couldn’t find a license for him with the DRE. He gave me their direct # at (800) 760-1833 and he told me that out-of-state loans are processed for Dana Capital.
Is there a mortgage company that’s NOT marketing for Dana Capital?
So I spoke with Steve Daniels and of course he recommended that I have my fax # removed. He pretended to not know about any problem with junk faxes and pointed at “Bridge Marketing.”
I decided to send him a followup mail with a few links to make sure that he’s aware of his liability for treble damages, that he and his company are getting some very bad PR and that I’d like to find out who really sends the faxes.

The new phone # 800-862-5690 on yesterday’s fax was answered at almost midnight PST by “Cindy” - after hours calls are forwarded to her cell phone.
She wouldn’t provide her last name and told me to call tomorrow. She gave me the number for the “main office”, the 800-310-9008 - which is the Mortgage Center number. I called and it was still answered as “Mortgage Center.”

The owner of the real companiy MortgageStar recently contacted me because he’d been accused of sending these faxes.
As I previously posted, I had been given their website when I called Mortgage Center. That’s because when someone is told to go to themortgagestar.com they don’t add “the” to the URL.
It’s obviously the same fax, they just changed from “Center” to “Star”, added the URL and now you get a cruise with your loan.

I may end up with the record for the longest press release. I tried to shorten it, but there was just so much I needed to get in for proper search results:
NAMES - lots of names, of the people and companies involved.
PHONE NUMBERS - the numbers on the faxes.
I almost limited the release to Dana Capital, but I think it’s important to show how I’m dealing with numerous junk faxers and I had promised Keith Hyatt a press release.
In the future, I’ll try to limit myself to just one scam and I’ll send out releases a lot more often.
