Update to Ameriquest counter settlement offer

After posting last week my thoughts on settlements, I had a long talk with Ameriquest attorney Jeffrey Messing on Thu afternoon.

I really did not want to submit any offer for a confidential settlement because I just don’t want to settle with Ameriquest, so that once again they can claim that they had done NOTHING wrong and are not admitting any wrong doing.

Eventually, I told him that I’d settle for $100K - an amount that would buy me a lawyer and I could finally go on a vacation for a few weeks.  Working every day gets old.

He laughed and assured me that Ameriquest wouldn’t pay that much.

Oh well ... maybe they ought to submit an offer of judgment.

Of course on offer of judgment would only apply to the current claims in my suit and Messing knows that I have two claims for the promo inquiries without permissible purpose and he correctly assumed that I’d accept the offer of judgment and I would immediately file a new suit for the inquiries.  Obviously, that’s not what Ameriquest wants.

So I agreed that I would accept an offer of judgment for $5K with an agreement to settle ALL my claims. 

Messing told me that he had no idea whether Ameriquest would consider an offer of judgment.  We shall see.

I found it interesting that I had previously thought that a settlement with a confidentiality clause and waiving the right to file complaints with regulators would be worth about 3 times more than a judgment.  But there’s really no rule and as you can see, when it comes to Ameriquest, I’m looking at 20 times more.

That’s what they get for being so obnoxious.

I’d forgotten all about filing a complaint with the AZ AG, been so busy.  Another AZ resident had complained about Compass Bank and the AG’s office actually investigated.  Just have to get it together and get that submitted.
