Debt buyer Acarta superior and appeals court filings
I prevailed on appeal. While the appeals court ignored the issue of the statute of limitations, it remanded to superior court because much of Acarta's documentation was not admissible.

Remember that you should cite YOUR state's case law, but even if you're not in Arizona, you'll see what to search for and how to present your arguments. 

I'm NOT a lawyer, but did prevail.  I accepted Acarta's offer for judgment for my counter claim and they finally dropped their claim because they knew that if they took their claim to trial, they'd likely lose or I'd appeal again.
