Midland Funding LLC v. Baker: the justice court suit for a HSBC credit card filed by Bursey & Associates, P.C. | Baker v Midland Funding, MCM and Bursey & Associates | Litigation Forum

On June 11, 2012 Bursey & Associates filed the lawsuit dated 2/10/12 in Kingman justice court.  The short story is that I responded to the Midland motion for summary judgment regarding its claim with a cross-motion for summary judgment and Midland then requested additional time to respond, its motion was granted, they failed to respond and the court then ruled that the SOL had expired.

It doesn't look like a big deal, but check out the countless filings on the docket (attached).

I then filed a notice of appeal because the judge had also dismissed my counterclaims, but I just didn't have time to write the appeal brief and decided to sue Midland, its servicer MCM and its attorneys for continuing to litigate despite my notice that the SOL had  expired, their litigation misconduct and false credit reporting by MCM.  I also named paralegal Gina Scalese because she promised to email the filings and then did NOT do so.
