A reader requested my response to the Midland statement of facts and it is attached below.
Also, I filed my response on 12/31 and Bursey & Associates filed a motion stating that I had failed to respond and requested judgment. Then they apparently received my filings and they requested an extension of time to file their response /reply so they could research the issues and they got 30 days. And then they filed nothing.
The judge then granted my cross motion because the SOL had expired.
And, as you probably know, a year later I sued Bursey & Associates, several of their attorneys, Midland and MCM for FDCPA and FCRA violations and that lawsuit keeps on going and almost certainly will go to the court of appeals. I update the blog and post those filings as time permits.
