Statue of limitations for FDCPA claims due to litigation
Midland's and Bursey & Associates' motion for judgment on the pleadings granted because the "[f]iling a complaint is the debt collector’s last opportunity to comply with the Act." [Naas]

Naas v. Stolman, 130 F.3d 892, 893 (9th Cir.1997) (SOL runs on the date an offending lawsuit was filed).
In Naas the ONLY alleged violation was the filing of the lawsuit, NOT attorney misconduct during litigation.

Lyons v. Michael & Assocs., 2013 WL 4680179 (S.D. Cal. Aug. 28, 2013) [venue]
From the 1/30/14 ORDER: "Defendants cite the recent decision in Lyons v. Michael & Assocs., 2013 WL 4680179 (S.D. Cal. Aug. 28, 2013), for the premise that the statute of limitations begins to run on the date an offending lawsuit is filed." However, Lyons had no claims regarding violations AFTER the filing of the debt collection suit.
